myMLA Terms of Use
Your access and use of this Portal is conditional upon your acceptance of, and compliance with these Terms of Use and the Privacy Policy, which include terms that: (a) limit our liability for certain types of loss or damage; If, after having read the Terms of Use you do not accept them, you should log out from the Portal. Your continued use of this Portal indicates your acceptance and acknowledgement of the Terms of Use. |
PART 1: GENERAL
1 General
1.1 The myMLA portal (“Portal”) is owned and operated by Meat & Livestock Australia Limited (ABN 39 081 678 364) ("MLA", "we" or "us"). Our main trading address in Australia is Level 1, 40 Mount Street, North Sydney, NSW Australia 2060.
1.2 "You" or "your" means a user of the Portal including, in the case of any minor, the minor's parent or guardian.
1.3 Your access to this Portal is subject to the general terms set out in Part 1, the application-specific terms set out in Part 2 and any additional terms, notices and disclaimers which appear on the Portal (“Terms of Use”). By using this Portal, you confirm that you accept these Terms of Use and that you agree to comply with them. If you do not agree to these Terms of Use, please do not use this Portal.
1.4 MLA may alter these Terms of Use from time to time. We will clearly state the date these Terms of Use were last changed. MLA will use reasonable endeavours to notify you of changes to these Terms of Use, other than trivial or insignificant changes. If the changes are:
(a) likely to benefit you or have neutral impact on you; or
(b) required by law or necessary for security reasons, to prevent fraud or technical reasons,
those changes will take effect from the date on which the relevant terms are changed on our Portal.
Every time you wish to use the Portal, please check these terms to ensure you understand the terms which apply at that time.
1.5 For any other material changes we make to these Terms of Use, MLA will provide you with notice of these material changes by email and notification on the Portal dashboard at least 14 days before the date they become effective. Your continued use of this Portal following those changes indicates your acceptance of those changes.
1.6 Use of this Portal does not create a client or professional services relationship between you and MLA
1.7 These Terms of Use refer to the following policies, which also apply to your use of this Portal:
(a) MLA Privacy Policy, as applicable, which set out how we collect, handle, use, disclose and process any personal information or personal data (as the case may be), that we collect from you, or that you provide to us. By using this Portal, you consent to such collection, handling, use, disclosure and processing, and you confirm that all information and data provided by you is accurate; and
(b) Cookies Policy, which sets out information about the cookies on this Portal.
2 Registration
2.1 In order to access the Portal, you are required to register with your email address (“User ID”) and select a password. You are responsible for maintaining the security and confidentiality of your password and for all activities that occur under your email and password, whether or not you authorise those activities.
2.2 You agree to immediately notify us of any unauthorised use of your User ID or password of which you become aware.
2.3 MLA will not be responsible for any losses arising out of the unauthorised use of your User ID or password, unless caused by MLA’s wilful misconduct, fraud or gross negligence.
2.4 We have the right to disable any username or password at any time by providing reasonable notice, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.
3 Disclaimers about use and reliance on this Portal
3.1 This Portal has been compiled by MLA on the basis of information current at the time of publication and is correct only to the best of MLA’s knowledge. Changes in circumstances after publication may affect the completeness or accuracy of this information. While MLA has used due care and skill, and has made every reasonable attempt has been made to ensure the accuracy of the information provided on this Portal, MLA makes no representations or warranties of any kind with respect to this Portal or its contents. It is your responsibility to assess and verify the accuracy, completeness, currency and reliability of the information on this Portal, and to seek professional advice where necessary.”
3.2 This Portal also contains tools which you can access. Assessments, predictions and calculations provided through these tools are estimates only and are based upon information you provide. You should only use these tools as a guide. MLA does not guarantee that the assessments, predictions and calculations through the tools are correct, up to date or will be applicable to your situation.
3.3 Further to paragraphs 3.1 and 3.2, by providing you with access to this Portal and the related services, MLA, its officers, employees, agents, contractors and advisers:
(a) are not offering to provide you with agronomic, technical, financial or other professional advice;
(b) are not legally responsible, or liable for, the accuracy, currency and reliability of any information appearing on this Portal, except in the event of MLA’s wilful misconduct, fraud or gross negligence;
(c) make no express or implied representation or warranty that any estimate or forecast will be achieved or that any statement as to future matters contained in this Portal will prove correct;
(d) accept no liability for any loss or damage suffered by any person as a result of that person, or any other person, placing any reliance on the contents of this Portal, unless such loss or damage is caused by MLA’s wilful misconduct, fraud or gross negligence; and
(e) assume no duty of disclosure or fiduciary duty to any interested party nor are we offering to provide you with any agronomic, technical, financial or other professional advice.
3.4 You, as user of the Portal, should make your own enquiries and seek professional, agronomic, technical, financial and legal advice before taking any action or entering into any transaction, either with MLA or a third party, based on or in reliance on the information or services provided on this Portal. MLA is not liable or responsible for any loss or damage suffered by you or a third party as a result of a decision you make based on the information or services provided on this Portal unless such loss or damage is caused by MLA’s wilful misconduct, fraud or gross negligence.
4 Limitation of Liability
4.1 The Competition and Consumer Act 2010 (Cth) (or equivalent regulation in other countries) may confer rights, guarantees and remedies on you in relation to the provision by MLA of goods and services, which cannot be excluded, restricted or modified. MLA does not exclude those rights. All other implied terms are excluded.
4.2 Your access to and use of this Portal is at your own risk. To the maximum extent permitted by law and without limiting clause 12.1:
(a) This Portal is provided on an ‘as is’ basis and MLA does not warrant, guarantee or make any representation regarding the use, or the results of the use, of the Portal, including the correctness, accuracy, reliability, completeness or currency of the Portal or its services or content or that security of the Portal will not be breached;
(b) MLA disclaims all warranties and guarantees that this Portal and its services, content or any linked websites or applications:
(i) will be free from errors, interruptions to the use of the website, viruses, worms, Trojan horses, bugs or similar components;
(ii) will not interfere with or damage your computer systems; or
(iii) will not infringe the intellectual property rights of third parties; and
(c) unless otherwise agreed in writing with MLA, MLA will not be liable for any direct, indirect, incidental, consequential, special or exemplary damages, losses, costs or expenses or lost profit, resulting from any use or misuse of this Portal or the services or information contained on this Portal ,to the extent not caused by MLA’s wilful misconduct, fraud or gross negligence.
4.3 To the maximum extent permitted by law, MLA's liability for breach of any consumer guarantee or any other mandatory local law, which cannot be excluded, is limited at the option of MLA to:
(a) in the case of services supplied or offered by MLA, which are not of a kind ordinarily acquired for personal, domestic or household use or consumption, resupplying or paying the cost of resupplying the service; or
(b) in the case of goods supplied or offered by MLA, which are not of a kind ordinarily acquired for personal, domestic or household use or consumption, replacing, supplying equivalent, repairing or paying the cost of replacing, supplying equivalent, repairing goods.
5 Linked/third party websites
5.1 The Portal contains links to websites operated by third parties. These websites are not under the control of MLA and we are not responsible for the condition, the content or currency of any linked websites.
5.2 Links to third party websites are provided solely for your information and convenience, and do not indicate, expressly or impliedly, any endorsement by MLA of the websites or the products or services provided in them. Nor does MLA endorse, approve or recommend the owners or operators of the linked websites. We have no control over those websites or the services made available through them, and accept no responsibility for them or for any loss or damage that may arise from your use of them, to the extent not caused by MLA’s wilful misconduct, fraud or gross negligence.
5.3 You must not create or maintain any link from another website to this website without the prior written consent of MLA.
5.4 The Portal also contains links to third party websites or applications where MLA has entered into an agreement with the third party to provide the service to you. Please see Part 2 of these terms for specific user terms of each application.
6 Intellectual Property and Copyright
6.1 All rights (including intellectual property rights such as copyright) in this Portal, its content and design are owned by or licensed to MLA. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
6.2 You may make a temporary copy of part or all of this Portal for the sole purpose of viewing it, and print or download a copy for personal use.
6.3 You must not otherwise reproduce, adapt, store, transmit, print, display, publish or create derivative works from any part of the content or design of this Portal except with MLA's prior written consent or as permitted by applicable copyright legislation.
7 MLA publications, reports and information
7.1 All use of MLA publications, reports and information on this Portal is also subject to MLA’s Market Reports, Data and Information - Terms of Use.
8 Trade Marks
8.1 All trade marks, trade names, service marks and other product and service names and logos on this Portal are owned by or licensed to MLA and are protected by applicable trade mark and copyright laws.
9 Content that you submit to us
9.1 If you post content on this Portal, you grant us an irrevocable, perpetual, non-exclusive, royalty-free, sub-licensable worldwide licence to use that content for any purpose, including marketing and promotion of our products and services from time to time. This includes a right to remove, modify, edit, crop, highlight and/or republish your content.
9.2 To the extent required to enable us to exercise our rights under these terms, you consent to any act or omission that would otherwise infringe your moral rights (as defined in the Copyright Act 1968 (Cth), and including any similar rights which are conferred by statute and which exist, or come to exist, anywhere in the world) in any content that you post on this Portal or otherwise provide to MLA.
9.3 You must not defame, libel, ridicule, mock, disparage, threaten, harass, intimidate, abuse, bully, trick, defraud or mislead other users. You warrant that any content submitted by you does not infringe the intellectual property or other rights of any third party or constitute a misuse of any person's confidential information.
9.4 Inappropriate content (as determined by us) is unwelcome and may be removed without notice. MLA will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting inappropriate content.
10 Collection of information and privacy
10.1 MLA may use “cookies” to make a record of your visit to this Portal and log your visit for statistical and business purposes. Such information may include your server address, domain name, IP address, the date and time of your visit, pages accessed, documents downloaded, previous website visited and the type of browser used. Some of this information may be capable of personally identifying you. Please refer to the MLA Privacy Policy for more details.
10.2 MLA may also require you to complete an electronic form on the Portal and in doing so require you to provide personal information. Where applicable, we may request your consent for certain processing activities (e.g. to receive marketing or promotional materials).
10.3 MLA will collect, store, use and disclose personal information or personal data, as the case may be, in accordance with the MLA Privacy Policy, as applicable.
11 Security
11.1 MLA uses appropriate technical and organisational measures with the aim of making all information received from you secure against misuse, accidental loss, destruction or damage, and unauthorised access, modification and disclosure. However, MLA makes no warranty in respect of its security measures and, subject to applicable privacy and data protection laws (in respect of personal information and personal data only), is not responsible for any misuse, loss and unauthorised access, modification and disclosure of information provided by you to MLA, except in the event of MLA’s wilful misconduct, fraud or gross negligence.
11.2 Your access to and use of this Portal is at your own risk. The internet is not secure and MLA cannot guarantee that the Portal will always be available or fault or virus free.
11.3 MLA is not liable to you or third parties if interference with or damage to your computer system occurs in connection with use of this Portal or any linked websites, except in the event of MLA’s wilful misconduct, fraud or gross negligence.
12 Restrictions on use
12.1 Without limiting any other provision of these terms, you agree that you shall not (and you agree not to allow any other individual or entity using your User ID to):
(a) download, modify or reverse engineer any part of the Portal;
(b) use any robot, spider, site search or other device to retrieve or index any part of the Portal;
(c) create user accounts under fraudulent or false pretences;
(d) create or transmit to any other uses of the Portal any unsolicited electronic communications, or otherwise interfere with other users’ enjoyment of the Portal
(e) use the Portal to violate the security of or gain unauthorised access to any computer or computer network or other device or system;
(f) use the Portal to violate any applicable laws or regulations; or
(g) transmit or upload to the Portal any item containing any virus, worm, defect, Trojan horse, software bomb or other feature designed to damage or degrade in any manner the performance of the Portal or any other website, or any other computer or device or system, or the enjoyment of the Portal by others.
13 Termination and Suspension
MLA reserves the right, with reasonable notice and in its sole discretion, to discontinue, terminate or suspend any service offered through or by this Portal, or your access to this Portal, at any time.
14 Governing Law
The Portal’s server is hosted in Australia. These Terms of Use are governed by the law applicable in the State of New South Wales, Australia.
PART 2: APPLICATION SPECIFIC TERMS
1.1 National Feedbase Monitoring Tool – Cibo Labs
By using the National Feedbase Monitoring Tool (“Feedbase Tool”), you acknowledge:
(a) the Feedbase Tool has been developed by Cibo Labs Pty Ltd;
(b) the Feedbase Tool is designed to help you understand the biomass of your property. However, MLA has not independently verified the forecasts and predictions in the Feedbase Tool; and
(c) MLA makes no representations and, to the extent permitted by law, excludes all warranties in relation to the information contained in the Feedbase Tool.
1.2 National Livestock Identification System (“NLIS”)
By accessing your NLIS account via the Portal, you acknowledge:
(a) the NLIS is monitored by Integrity Systems Company Limited (ABN 34 134 745 038); and
(b) your use of the NLIS is governed by the NLIS Terms of Use linked here.
1.3 Livestock Production Assurance (“LPA”)
By accessing your LPA account via the Portal, you acknowledge:
(a) the LPA is monitored by Integrity Systems Company Limited (ABN 34 134 745 038);
(b) your use of the LPA is governed by the Integrity Systems Website Terms and Conditions linked here; and
(c) your participation in the LPA Program is governed by the LPA Rules linked here and the LPA Standards linked here.
1.4 Livestock Data Link (“LDL”)
By accessing the LDL via the Portal, you acknowledge:
(a) the LDL is hosted by Integrity Systems Company Limited (ABN 34 134 745 038) (“ISC”);
(b) your use of the LDL is governed by the Integrity Systems Website Terms and Conditions linked here; and
(c) your data may be shared in deidentified and aggregated form into other databases or online resources such as MyFeedback that are operated by ISC.
1.5 MyFeedback
By accessing MyFeedback via the Portal, you acknowledge:
(a) the myFeedback is hosted by ISC; and
(b) your use of myFeedback is governed by the Integrity Systems Website Terms of Use linked here.
1.6 Meat Standards Australia - myMSA ( “myMSA”)
By accessing your myMSA account via the Portal, you acknowledge:
(a) the myMSA website is owned and operated by Meat & Livestock Australia Limited (ABN 39 081 678 364);
(b) myMSA is designed to provide feedback on the eating quality performance and compliance to Meat Standards Australia requirements of MSA graded carcases; and
(c) your use of the myMSA website is governed by the myMSA terms of use linked here.
1.7 Sheep Genetics
By accessing Sheep Genetics via the Portal, you acknowledge:
(a) the Sheep Genetics website is owned and operated by Meat & Livestock Australia Limited (ABN 39 081 678 364);
(b) your use of the Sheep Genetics website is governed by the MLA terms of use linked here.
